Terms of Use

1. Parties Involved:

• This Agreement is made between Laine Lipsky Coaching (hereinafter referred to as "Coach") and You (hereinafter referred to as "Client"). 

2. Scope of Services:

• The Coach will provide coaching services to the Client, based on Client selection, which include one or more of the following: Personal Empowerment Coaching, Private Parent Coaching, Stop Yelling Training Program, Cancer Mindset Coaching (CMC), O.N.E. Reset Workshop.

• The coaching relationship will focus on areas to include one or more of the following: Parenting, Life, Cancer.

• The Coach is not a therapist, counselor, or medical professional, and the coaching services are not a substitute for professional advice in those areas. 

3. Duration and Frequency:

• The term of this Agreement varies per service selected as outlined in service description.

• Coaching sessions will be conducted as outlined in service description of selected service.

• Sessions may be held online via Zoom or possibly, in person (workshops only).

4. Fees and Payment:

• The total fee for the coaching services varies per service selected as outlined in service description as follows: Private Coaching and Workshops pay upfront; CMC pay monthly subscription fee of $97 before any discount is applied.

• Payment is due upon purchase of service and can be made via online website platform.

• Late payment fees of [10%] will be applied for payments received after the due date. 

5. Scheduling, Cancellation, Rescheduling, and Refunds:

• Clients must provide 24 hours' notice for cancellations or rescheduling of sessions.

• The Coach reserves the right to charge a fee of full session rate for missed sessions if the Client does not provide adequate notice.

• The Coach will make reasonable efforts to accommodate rescheduling requests.

• Refund requests must be submitted in writing and will be granted at The Coach's discretion.

6. Confidentiality:

• All information shared during coaching sessions will be kept confidential, except as required by law.

• The Coach will not disclose Client information to any third party without prior written consent, except in cases of legal obligation. 

7. Termination:

• Either party may terminate this Agreement with 7 days' written notice.

• The Coach may terminate this Agreement immediately if the Client fails to make payments as agreed. 

8. Disclaimer:

• The Client understands that coaching is not a substitute for professional advice in areas such as mental health, medical, or legal matters.

• The Client is responsible for their own choices and actions during and after the coaching relationship.

9. Dispute Resolution:

We are committed to creating a positive and respectful experience for all clients. In the event of any dispute, claim, or disagreement arising out of or relating to our coaching services—whether individual or group sessions—and/or these Terms and Conditions, both parties agree to first make a good faith effort to resolve the matter informally through direct communication.

If a resolution cannot be reached within 30 days, both parties agree to submit the dispute to binding arbitration in accordance with the rules of the American Arbitration Association (AAA), to be held in [San Diego County], California. Arbitration shall be conducted by a single, neutral arbitrator, and all proceedings will remain confidential. The decision of the arbitrator will be final and enforceable in any court of competent jurisdiction.

This agreement to arbitrate applies to all claims, including but not limited to those arising from individual coaching sessions, group programs, courses, or workshops.

Notwithstanding the above, either party may seek temporary or preliminary injunctive relief in a court located in California if necessary to protect their intellectual property or confidential information.

Each party is responsible for its own legal fees and costs unless the arbitrator decides otherwise.

By engaging in coaching services, you agree to this method of dispute resolution.
